1. Scope
 

These General Terms and Conditions apply to purchases made through the online shop operated under the name *Lux by Jes* at:

These Terms apply to contracts between Lux by Jes and customers purchasing products through the online shop.

A consumer is a natural person who enters into a legal transaction primarily for purposes that cannot be attributed to their commercial or independent professional activity.

An entrepreneur is a natural or legal person, or a partnership with legal capacity, acting in the course of its commercial or independent professional activity.

Any individual agreement made with a customer takes priority over these General Terms and Conditions.
 

2. Products offered
 

Lux by Jes sells *brand-new, pre-owned and vintage branded bags and related accessories*.

Because many of our pre-owned and vintage products are individually sourced, only one unit of a particular item may be available.

The essential characteristics, condition, dimensions and other relevant information about a product are provided on the relevant product page.

Product photographs form part of the product description.

Colours may appear slightly different depending on the customer's screen, lighting and device settings.

Original accessories such as boxes, original dust bags, receipts, authenticity cards, detachable straps or other branded accessories are included where available.

Pre-owned bags that do not have their original dust bag will be provided with a *protective dust bag*.
 

3. Preloved and vintage condition
 

Pre-owned and vintage products may show signs of previous use, storage, ageing or natural material variation.

We aim to describe and photograph each product carefully and accurately.

Relevant signs of wear or characteristics known to us may be stated in the product description or shown in the photographs.

These may include scratches, marks, stains, discolouration, hardware wear, odours, shape changes or other signs associated with previous use or age.

Where a product has a condition or characteristic that differs from what would normally be expected, this will be disclosed before purchase and, where required by law, separately agreed with the customer.

A characteristic that has been specifically and validly agreed as part of the product's condition does not constitute a defect merely because the product is pre-owned or vintage.

The customer's statutory rights concerning undisclosed defects or products that materially differ from their agreed description remain unaffected.
 

4. Authenticity
 

Branded products offered by Lux by Jes are sold as authentic.
 

Some pre-owned products may come with original documentation or accessories, such as an authenticity card, receipt, original dust bag or box. Lux by Jes does not provide independent authentication certificates.

Customers who would like additional authentication may use an independent professional authentication service at their own cost.

We are happy to recommend independent authentication services upon request.

Unless expressly stated otherwise, Lux by Jes is an independent reseller and is not affiliated with, sponsored by or officially connected to the brands whose products are offered.

Brand names and trademarks belong to their respective owners and are used solely to identify and describe the products.
 

5. Product listings and availability

The display of a product in our online shop does not by itself constitute a legally binding offer.

It is an invitation for the customer to submit an order. All products are subject to availability.

Because many pre-owned and vintage products are unique pieces, an item may become unavailable after it has been sold.

Although we take reasonable steps to keep inventory information accurate, an item may occasionally become unavailable because of simultaneous orders, inventory errors, damage discovered during final inspection or other circumstances.

If an ordered item is unavailable, we will inform the customer without undue delay.

Any payment already received for an unavailable item will be refunded using the original payment method unless another method has been agreed.

We are not required to supply an alternative product unless separately agreed with the customer.
 

6. Ordering Process and Contract Formation
 

Customers may select products and place them in the shopping cart using the functions provided on our website.

Before submitting an order, customers can review their selected products, remove products from the shopping cart, review billing and delivery information, select available delivery and payment methods, and correct input errors using the functions provided during checkout.

The customer submits a binding offer to purchase the products in the shopping cart by clicking the final ordering button indicating that the order creates an obligation to pay.

After submitting the order, the customer will receive an electronic acknowledgement confirming receipt of the order.

An automatically generated acknowledgement of receipt does not constitute acceptance of the customer's offer unless it expressly states that the order has been accepted.

The purchase contract is concluded when Lux by Jes:

* sends an express order-acceptance confirmation;
* confirms that the order has been dispatched; or
* otherwise expressly accepts the order, whichever occurs first.
 

7. Contract Language and Order Information
 

The language available for concluding the contract is *English*.

Order details and these General Terms and Conditions will be provided electronically as part of the ordering process or order confirmation where applicable.

Lux by Jes stores order information in accordance with applicable legal and accounting requirements.

Customers with a registered customer account may be able to access certain order information through their account.

Customers are encouraged to save their order confirmation and the Terms applicable when the order was placed.
 

8. Prices and taxes
 

All prices are stated in *Euro (EUR)* and are final prices.

For *brand-new products*, prices include the applicable *19% German Value Added Tax (VAT)*.

Qualifying *pre-owned products* are subject to the *margin taxation scheme (Differenzbesteuerung) pursuant to Section 25a of the German VAT Act (UStG)*.

For these products, VAT is not shown separately. Shipping costs and any other applicable additional charges are displayed separately during checkout before the customer places the order.

For deliveries outside the EU customs territory, additional charges such as import VAT, customs duties, customs-clearance fees or carrier handling fees may apply. Unless expressly stated otherwise, these charges are not included in the product price or shipping costs and are normally payable by the recipient.

Lux by Jes does not determine or control taxes, customs duties or other charges imposed by authorities in the destination country.
 

9. Payment
 

The payment methods currently available are displayed during checkout.

Depending on the options available on our website, these may include:

* PayPal Checkout
* Credit or debit cards available through PayPal Checkout
* Bank transfer, where offered

Payment is generally due when the order is placed unless another payment arrangement is expressly offered.

Lux by Jes may withhold dispatch until payment has been successfully received or authorised.

Where bank transfer is offered, the relevant payment instructions will be provided during or after checkout.

The order may not be dispatched until payment has been received in full.

Lux by Jes does not offer layaway or payment by instalments unless expressly agreed and permitted by applicable law.
 

10. Delivery area
 

Lux by Jes currently ships within *Germany and to various countries across Europe*.

Selected destinations outside Europe may also be available upon request.

The destinations currently available for online orders will be displayed during checkout.

If a customer's country is not available during checkout, the customer should contact Lux by Jes before placing an order.

Shipping availability to destinations not offered during checkout is subject to prior confirmation by Lux by Jes.
 

11. Processing and delivery
 

Orders are normally processed and prepared for dispatch within *1–2 business days* after payment confirmation.

Business days are Monday to Friday, excluding public holidays applicable at our place of business in Germany.

Estimated delivery periods are provided in our separate *Shipping Policy* and, where applicable, during checkout.

Delivery times may vary because of weekends, public holidays, customs processing, carrier disruptions, severe weather or other circumstances outside our reasonable control.

Where no different delivery period has been agreed, delivery will take place within the period required by applicable law.

If an order contains several products, Lux by Jes may send the products together or in separate parcels where reasonable.

The customer will not be charged additional shipping costs solely because Lux by Jes chooses to send an order in separate parcels.

Mandatory statutory rights relating to delayed delivery remain unaffected.
 

12. Shipping and Tracking

Orders are shipped using the shipping services available for the relevant destination.

Where tracking is available, customers will receive tracking information after the order has been dispatched.

Customers are encouraged to monitor available tracking information and make reasonable arrangements to receive or collect their parcel where necessary.

This does not affect Lux by Jes's responsibility for the shipment or the customer's statutory consumer rights. Further information is provided in our *Shipping Policy*.
 

13. Failed delivery and returned parcels
 

If a shipment is returned to Lux by Jes because the customer provided an incorrect or incomplete address or, through circumstances for which the customer is responsible, failed to accept or collect the shipment, Lux by Jes may charge reasonable additional return or reshipping costs actually incurred, to the extent permitted by applicable law.

Lux by Jes will contact the customer before arranging reshipment.

This provision does not apply where the customer has validly exercised a statutory right of withdrawal or another statutory consumer right.

Simply refusing or failing to collect a parcel does not necessarily constitute a valid withdrawal declaration.

A consumer wishing to withdraw should clearly communicate their decision to Lux by Jes.

14. Transfer of risk
 

For consumers, the risk of accidental loss or accidental damage generally passes to the customer when the customer, or a third party nominated by the customer other than the carrier, receives the goods.

This does not apply where the consumer independently appoints a carrier that was not offered by Lux by Jes.

For entrepreneurs, the applicable statutory rules concerning transfer of risk apply unless otherwise agreed.
 

15. Retention of title
 

Products remain the property of Lux by Jes until the purchase price and any applicable agreed charges have been paid in full.
 

16. Right of withdrawal
 

Consumers generally have a statutory right to withdraw from an online purchase in accordance with applicable law.

The withdrawal period, procedure, return address, consequences of withdrawal and Model Withdrawal Form are explained in our separate *Withdrawal, Returns and Refund Policy* and related withdrawal information.

Where required by applicable law, Lux by Jes provides an electronic withdrawal function through the online interface that allows consumers to submit a withdrawal declaration electronically.

The electronic withdrawal function does not replace other legally permitted methods of exercising the statutory right of withdrawal.

Nothing in these Terms excludes, limits or replaces a consumer's statutory right of withdrawal.
 

17. Return shipping
 

Responsibility for return shipping costs is explained in our *Withdrawal, Returns and Refund Policy*.

When a consumer exercises the statutory right of withdrawal because they have changed their mind, the consumer bears the direct return cost where they were properly informed of this responsibility before placing the order.

Lux by Jes will bear necessary return costs where required by applicable law, including where a product is defective, materially different from its description or incorrectly supplied.

Customers should use suitable protective packaging when returning products.

For higher-value items, we strongly recommend using a tracked and appropriately insured return service.
 

18. Statutory rights concerning defects
 

Customers' statutory rights concerning defective or non-conforming goods apply.

If a product is defective or does not conform to the contract, the customer may be entitled to statutory remedies in accordance with applicable law.

Depending on the circumstances, these may include supplementary performance, repair, replacement where available, a reduction in price, withdrawal from the contract or damages.

Because many Lux by Jes pre-owned and vintage products are individually sourced and unique pieces, an identical replacement may not always be available.

This does not affect the customer's other statutory rights.

Unless expressly stated for a particular product, Lux by Jes does not provide a separate voluntary commercial guarantee in addition to statutory rights.

The statutory limitation period for defect claims is not shortened by these General Terms and Conditions.
 

19. Reporting damaged, incorrect or defective products
 

Customers should contact Lux by Jes as soon as reasonably possible if:

* the wrong product was delivered;
* a product arrived damaged;
* an undisclosed defect is discovered; or
* a product materially differs from its agreed description.

Where reasonably possible, customers should provide:

* their name and order number;
* a description of the problem;
* photographs of the product;
* photographs of the outer packaging and shipping label where transport damage is involved; and
* other information reasonably required to investigate the issue.

Failure to report an issue immediately does not remove a consumer's statutory rights.

Prompt reporting may, however, help us investigate the matter with the shipping carrier or insurance provider.
 

20. Liability
 

Lux by Jes has unlimited liability:

* for intentional misconduct and gross negligence;
* for injury to life, body or health;
* under applicable product-liability law;
* where a guarantee has expressly been given; and
* in any other situation where liability cannot legally be limited or excluded.

For damage caused by slight negligence, Lux by Jes is liable where an essential contractual obligation has been breached.

An essential contractual obligation is an obligation whose performance is necessary for the proper execution of the contract and on which the customer may normally rely.

In such cases, liability is limited to the type of damage that was reasonably foreseeable when the contract was concluded, to the extent permitted by law.

Mandatory consumer rights remain unaffected.
 

21. Customer accounts
 

Customers may be able to place an order as a guest or through a customer account, depending on the options available on the website.

Customers are responsible for keeping their account login details confidential and should notify Lux by Jes if they believe their account has been used without authorisation.

Lux by Jes may suspend or close an account where reasonably necessary because of misuse, fraud, security concerns or a serious breach of these Terms.

Closing a customer account does not affect orders or legal obligations that already exist.
 

22. Intellectual property and website content
 

Original photographs, written descriptions, graphics, logos and other original content belonging to Lux by Jes may be protected by copyright, trademark or other intellectual-property rights.

Customers and website visitors may not reproduce, publish, sell, commercially use or distribute Lux by Jes content without prior permission, except where legally permitted.

Third-party brand names and trademarks remain the property of their respective owners.
 

23. Data protection
 

Personal information is processed in accordance with our *Privacy Policy*.

Our Privacy Policy provides information about how personal data is collected and processed and about the rights available to data subjects.
 

24. Consumer dispute resolution
 

Lux by Jes is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless participation becomes mandatory under applicable law.
 

25. Applicable law
 

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not deprive them of mandatory consumer protections applicable under the law of the country in which they have their habitual residence.

Mandatory statutory jurisdiction rules remain unaffected. No exclusive German court jurisdiction is imposed on consumers where such a provision would be legally invalid.
 

26. Amendments to these Terms
 

The version of these General Terms and Conditions applicable when an order is placed applies to that order.

Lux by Jes may update these Terms for future orders where necessary because of changes to the website, business operations or applicable law.

Changes will not retroactively alter an existing purchase contract without the customer's agreement unless legally permitted.
 

27. Severability
 

If an individual provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.

The applicable statutory provisions apply in place of any invalid provision.
